State-specific Regulatory Programs

Occasionally, the State Air Pollution Control Board, either on its own or at the behest of the General Assembly, will promulgate a regulation that applies only in Virginia and is not part of any federal plan.

The following programs are authorized under state law only:

  • Air toxics - For existing sources, see Article 4 of 9VAC5 Chapter 60. For new sources, see Article 5 of 9VAC5 Chapter 60.
  • Odor - For existing sources, see Article 2 of 9VAC5 Chapter 40. For new sources see Article 2 of 9VAC5 Chapter 50.
  • Medical Waste Incinerators - For new sources, see Article 6 of 9VAC5 Chapter 50.
  • Mediation and alternative dispute resolution - See 9VAC5 Chapter 210

In addition, the board adopts variances and general permits to address specific situations on a case by case basis.
