The 1995 Virginia General Assembly adopted House Bill 1847 to amend the Code of Virginia by adding in Chapter 14 of Title 10.1, an article numbered 4.1, consisting of Sections 10.1-1429.1 through 10.1-1429.3, entitled "Voluntary Remediation." Section 10.1-1429.1.A of the statute requires the Waste Management Board to promulgate regulations. Regulations governing voluntary remediation were promulgated on June 26, 1997 and revised on July 1, 2002.

On April 1, 2002, the Virginia General Assembly enacted the Brownfield Restoration and Land Renewal Act by amending the Code of Virginia by adding in Title 10.1, a chapter numbered 12.1, consisting of sections numbered 10.1-1230 through 10.1-1237. Sections 10.1-1429.1 through 10.1-1429.3 were repealed and amended to the Code of Virginia as Section 10.1-1232 of the Brownfield Restoration and Land Renewal Act. The statutory authority of the Voluntary Remediation Program is now found in this section.
